Copyright Guidelines for Online Course Development: Overview

The purpose of this Guide is to assist faculty in making informed decisions about copyright and the use of copyrighted materials in online and blended courses.

Guide Purpose

The purpose of this Guide is to assist faculty in making informed decisions about copyright and the use of copyrighted materials in online and blended courses.

It is not intended to replace the advice of legal counsel for specific copyright scenarios.

Important Considerations

•       There are few “bright line” rulings as to what constitutes acceptable use of copyright work in online courses.

•       In general, the principles of “fair use” that govern the quantity and type of materials used in face to face classes also apply to online and blended classes.   Use the calendar restrictions available in most online teaching programs (i.e., Blackboard) to mimic the durational aspect of classroom access.

•       To avoid infringement claims, it is always best practice to secure permission from the copyright owner.
